I&#039;m assuming you mean a situation in which the employee receives on-call pay, but the employee is not actually at work. If this is the case, I believe the hours while on call are not calculated in determining if total hours worked exceed the 40 hour work week. However, if the employee goes to work because they are called in, this work would be subject to the 40 hours worked in the 7 day period. Any hours worked above the 40 are subject to receiving the premium.

Just a reminder: company policy, union contracts and the like can affect the above determination. I don&#039;t pretend to be an attorney so if its a legal opinion you seek, keep seeking :-)
